Terms of Usage
The utilization of the Crenex.com website (utilization to include the usage or purchase of any goods, subscriptions, or services for fee or free of charge, offered by us or any entity we are in agreement with, surfing, browsing, reading and posting of any information, acceptance of recommendations, instructions or advice) is subject to your unconditional agreement to our Terms of Usage. Crenex.com is intended for persons at least 18 years of age and enrolled at an academic institution or involved professionally in the real estate industry. You agree that you are a person at least 18 years of age, enrolled in an academic program focused on real estate, and or involved in the real estate industry in a professional capacity.
Liability & Indemnity Agreement
In no event shall Crenex.com, its employees, contributors, owner(s), affiliates, licensors, developers, contractors and or subcontractors be liable for any direct, indirect, incidental, punitive, special or consequential damages that may result from your use of, inability to use, limited use or misuse of the Crenex.com website or any products or services offered by us or any other parties/entities we partner, contract, associate, or are in agreement with. In addition to original content and services, we may partner with other companies and organizations to bring you 'free' or 'for fee' products and services. You agree to use these products and or services at your own risk and release Crenex.com and any vendor providing the product or service from any and all liability. You agree to defend, indemnify, and hold harmless Crenex.com, its employees, contributors, owner(s), affiliates, licensors, developers, contractors and or subcontractors from all liabilities, claims, and expenses, including attorneys' fees that may arise from your use of, inability to use, limited use or misuse of our website and or products or services, be they free or for fee. Crenex.com reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you agree to assist and cooperate with us in asserting any such defense.

All original content on the Crenex.com website including but not limited to documents, member/user data, company profiles, audio and video files, databases, programming code, scripting and artwork are the sole copyright of Crenex Inc. You agree to not reproduce and or distribute this content for any reason unless authorized by Crenex Inc. in the form of expressed written permission. In addition to original content, we post, share, link to and make users aware of additional content on the web which remains the copyright of its original authors and or owner(s). You agree to respect the copyright of any posted or linked content and not replicate or distribute it without its owner(s) permission. You also agree to not share copyrighted content on Crenex.com by private messaging, posting or submitting any material for which you do not have ownership, or permission to share.
Account Creation, Maintenance & Security
Some features of Crenex.com require users to create and maintain an account. Account creation requires users to provide personal information, some of which may be personally identifiable. You agree to provide information that is accurate to the best of your knowledge and not overtly falsify information such as names of schools attended. You agree to keep confidential the login details of your account (username and password) and not share them anyone else. You also agree to notify us immediately of any unauthorized use of your account. This is required of you to protect your account security and maintain the website’s integrity.
You have the right to abandon your account at any time. We consider failure to login for more than 12 months abandonment, after which your account may automatically be deleted. You also have the right to request deletion of your account at anytime. Account deletion requests are usually completed in 30 days but we may take up to 90 days to delete an account.
For 'Paid Membership' and 'Paid' products or services, cancellation of your account will not result in a refund. Refunds will be made at our sole discretion. Paid Memberships are made available on a ‘single seat license’ basis and not intended for use by multiple persons i.e. shared amongst a workgroup at a company, unless specifically stated otherwise. You agree to not violate this policy. If multiple accesses (multiple people using the same account as determined by IP Logs and or MAC addresses) are detected for an account, that account will be suspended or revoked. We reserve the right to revoke, cancel, modify, delete or temporarily suspend any account and or usage privileges of any member for any reason without prior notice. As a courtesy, we usually give advance notice to a member(s) prior to implementing any changes that affect their account status, but are under no obligation to do so.
Member Rules of Conduct
You agree to abide by the Member Rules of Conduct detailed below. Utilization of the site in a manner which violates State or Federal law is prohibited.
(a) Interaction with other members – You agree to keep your communications polite and courteous. Harassing, threatening or belligerent online behavior is unacceptable. Please be advised that threatening someone is a crime and if a complaint is filed against you, you may be subject to legal action. If someone expresses their wish not to communicate with you, do not try to contact them, since that would constitute harassment. When interacting and or posting information that will be publicly displayed (i.e. information on your Friends Network profile page etc.) do not reveal any personally identifiable information such as home address or telephone number for security and privacy purposes.
(b) Language - We interpret the 1st amendment to not censor language. Feel free to express yourself however you wish, but be advised that there is a fine line between expressing yourself and being perceived as harassing and threatening someone. Keep swearing and the use of 'charged' phrases limited to personal expressions and do not direct them towards anyone in a bias manner. Do so and we may cancel your account and permanently ban you from Crenex.com.
(c) Information Confidentiality - Understand that you will be dealing with other professionals online and that certain information revealed to you may be considered confidential. You agree not to collect, help collect or inform any entity of any Crenex.com member's information that may be revealed to you. If information such as email addresses, telephone numbers, member/site statistics, which include but are not limited to member preferences, usage, visitation and transaction statistics and protocols are revealed to you, you agree to maintain the confidentiality of this information. Trawling for data constitutes DATA MINING and is strictly prohibited. We take DATA MINING seriously and if you are found to be collecting member details for purposes such as recruiting or site replication, we will not only take legal action but also mount a public PR campaign to highlight unethical behavior.
You also agree to not participate in, help or contribute in any way to any hacking or theft of information attempts directed at our website, server(s), or ISP and to alert and inform us of any attempt to the best of your ability. In addition, please be aware that your colleagues or peers may also be online as members; do not reveal confidential company or client information. It’s unethical and may even be illegal.
(d) SPAM - We define SPAM as sending unwanted email or private messages to individual members or groups. There is a fine line between introducing yourself to a select few members and spamming entire groups. Please note that we intend to comply with laws regarding spam and will not only report any spammer to regulatory authorities including Internet Service Providers, but will fine either the spammer, the entity being promoted, or both at our discretion a sum of money which will be determined by multiplying the number of members spammed by $100 USD, payable to us within 30 days of notification. No one likes spam. We especially hate it. You agree NOT to SPAM, help anyone else SPAM or provide any information to help a SPAMMER SPAM Crenex.com members. We may monitor account usage and do actively investigate SPAM complaints. If it is detected that you are spamming members or helping anyone do so, we will delete your account, permanently ban you from Crenex.com and its subsidiary sites, report you to your ISP, and fine you. Bottom line with regard to spam; just don't do it.
(e) Disrupting Website Functionality - You agree not to disrupt or help anyone disrupt website functionality, inflict damage or harm upon our website or members in any way. Childish behavior such as, causing a forum to scroll, posting hate messages, filing false complaints etc will not be tolerated. Forum administrators are given full authority to delete strings and ban members.
Advertising, Sponsorship, Contests & Prize Distribution
When advertising is placed on Crenex.com, your dealings with any advertisers, vendors or sponsors will solely be between you and the purveyor. We will not be responsible or liable in any way as a result of those dealings. We may at times hold contests with possible prizes. Relevant information will be provided with each contest and all Crenex.com decisions are final.
Governing Law - Any claims relating to Crenex.com shall be governed by the laws of the State of New York without regard to its conflict of law provisions.
Privacy Policy - We do not sell, lease or rent any member info to any commercial entity; the exception being the necessity to share account info as per information technology and product/service delivery purposes. In the course of utilizing the Crenex Community (our social network) website you will receive standard communication from other Crenex users. You have the option of adjusting your privacy settings to control who contacts you and what information about you is displayed with our social community. Member name and home city will be displayed in our member directory but contact details are not revealed to the general public or other Crenex Members.
Information that is gathered from users and registered members; in common with other websites, log files are stored on the web server saving details such as the visitor's IP address, browser type, referring page and time of visit. Cookies may be used to remember visitor preferences when interacting with the website. Where registration is required, the visitor's email and all information entered online including user name and personal information will be stored by us or an authorized vendor.
How the Information is used; the information is used to enhance the visitor’s experience when using the website to network with other professionals, display personalized content and possibly advertising. E-mail addresses will not be sold, rented or leased to 3rd parties. E-mails may be sent to inform you of news of our services or offers by us or our affiliates, industry news and updates, event alerts and system updates. Users have the option of opting out of these distribution lists at any time.
Modification of Terms of Usage
Crenex Inc. may revise these terms of use for its web site at any time without notice. By using this web site you are agreeing to be bound by the then current version of these Terms and Conditions of Use.
